| Summary, etc. | [2002] UKHL 23, 23 May 2002. On 15 September 1999 the defendant planning authority (H) resolved to grant planning permission for a 32 acre mixed-use development adjoining the claimant's (B) house. On 6 April 2000 B submitted an application for permission to apply for a judicial review of that decision, alleging failures in the Environmental Impact Assessment. On 12 May 2000 planning permission was granted. B's application for judicial review was dismissed by the CA ([2001] Env LR 684) on the grounds that it had not been made within the three month time limit, set to run from the date of the resolution. B was granted leave to appeal to HL. "Held": HL allowed appeal on the grounds that the three-month period in which to make an application for judicial review runs from the date that planning permission is granted, not from the date of the resolution.
