| Summary, etc. | The first of two articles on collateral warranties "Do you have collateral?" examines the clause which is often included in bespoke appointment of architects, because the right to call for collateral warranties is seen as a great benefit to the client in terms of the marketability of the project. However it advises against this as it increases the number of people who may seek to sue if there is a lawsuit. "To sign or not to sign" looks at the clauses to write in and cross out and suggests this clause is left out of the RIBA standard form of agreement (SFA 1999) for good reason. Argues that such a clause should include words to the effect that the architect 'shall owe no greater obligations to the beneficiary than it would owe if the beneficiary had been named as the client in the architect's appointment'. May also require the granting of a copyright licence in favour of the beneficiary. |
