Summary, etc. Considers "Beanby Estates Ltd v Egg Stores (Stamford Hill) Ltd" ([2003] EWHC 1252 (Ch), Abs67080) which provided an interpretation of the Landlord and Tenant Act 1927 s23. It was held that where a notice was sent by recorded delivery to the addressee at his place of abode, it was irrefutably deemed to have been served, it followed that service was deemed to have been made on the date of putting the notice in the post and not on the actual date of receipt.
