Summary, etc. LVT for London Rent Assessment Panel LON/ENF/481/00, 2 September 2003. Terms of acquisition of the freehold and headlease of a block of flats had been agreed between the nominee purchaser (C) and the freeholders and intermediate lessee (E) under the Leasehold Reform, Housing and Urban Development Act 1993 s24(4)(b) and sent to the LVT. A dispute over outstanding service charges prevented any binding contract being entered into by the parties within the two-month period specified by s24(6)(a) of the 1993 Act. A vesting order was granted to C and C paid the price into the court (see Abs67082). Without releasing the transfers as ordered, E applied to have their interests re-assessed pursuant to s24(4)(b) of the Act, arguing that 'a change of circumstances' had arisen within the meaning of s24(4)(b)(i) of the Act, namely that values had risen since the agreed valuation date in 2000. "Decision", the LVT concluded as a preliminary issue that it did not have jurisdiction to determine the amounts of service charge due under Sched 5 para 3(1)(b) of the Act because the appropriate sum had been paid into court pursuant to the vesting order. Increased property prices did not constitute a relevant change of circumstances. S24(4)(b) does not give the LVT discretion to ignore the statute's express provision as to valuation date.
