B's inspector had approved works on the excavations for the foundations and the damp-proof course of a new house, which subsequently deteriorated due to subsidence. D, the second owner, sought damages from B on the grounds that the work should not have been approved as it did not comply with the bye-laws. "Held": B owed a duty of care to D and was liable for the inspector's negligence
