| Summary, etc. | Considers the implications of the "Walle" ruling ([2004] EUECJ C-1/03) by the European Court of Justice in September 2004 for the future of brownfield regeneration. The judgment stated that unintentionally spilled hydrocarbons causing soil and groundwater contamination are waste as is soil contaminated by hydrocarbons, even if it has not been excavated. If unexcavated contaminated soil is defined as waste, landowners sitting on contaminated land will be committing an offence if they do not hold a waste management licence. Doubts have also been cast on who is responsible for enforcing the clean up of contaminated land. Although not all experts are convinced that the ruling is a major setback to brownfield redevelopment, most agree that there is a clear need for clarification of waste regulation responsibilities.
