| Summary, etc. | Examines "British Telecommunications plc v Geraghty and Miller International Inc" (QBD 29 July 2004, unreported). Employees of Geraghty had drilled through cables belonging to BT while working on a hole by a main road. Geraghty objected to BT's claim for damages and in particular the percentage uplift that BT claimed for overheads. BT argued it only needed to establish the costs it incurred as a result of the damages, but Geraghty contended that much of what BT sought compensation for were either for economic loss of not directly connected to the physical damage. The judge rejected Geraghty's concerns and held that BT was entitled to recover such overheads as the court decided were caused by the repair work, providing that BT could establish the amounts claimed had been reasonably and properly calculated. |
