520 ## - SUMMARY, ETC.
Summary, etc. [2005] UKHL 17, 3 March 2005. Considers whether the regulation and control of vehicle parking on a housing estate is a proper function of a local authority in the management of a housing estate under the Housing Act 1985 s21(1) and whether it facilitates, is conducive or incidental to a local authority's management of houses in the estate within the Local Government Act 1972 s111. Appeal by tenant (A) against the decision ([2002] EWCA Civ 582) dismissing his claim against the respondent local authority (H) for redress for parking ticket fines that A had been made to pay under H's estate parking scheme and damages for his car being wrongfully detained by clamping. "Held": appeal dismissed. Regulation and control of parking is an inherent part of managing the houses in a housing estate under s21(1) of the 1985 Act. S111 of the 1972 Act gave local authorities powers to do anything that was calculated to facilitate, was conducive or incidental to, the discharge of any of their functions. Parking regulation and control constituted a proper discharge of H's management of the houses on the estate. View judgment at www.parliament.the-stationery-office.co.uk.
