| Summary, etc. | [2005] EWCA Civ 555, 12 May 2005. Concerned the claim for misrepresentation over the dating of two urns, as to whether they were 18th or 19th century, an important issue in assessing their value. The appellant auctioneers (C) appealed against the decision (Abs67884) that they were in breach of duty of care to their client and liable in damages to the respondent (T) in respect of certain urns or vases sold to her at auction, and T cross-appealed. "Held": the appeal was allowed, the cross-appeal dismissed. The judge decided that on the balance of probabilities the urns were 18th century. C owed a single duty of care in describing the vases in the catalogue and to T but did not need to inform T of any doubts of which they were aware, having reached an opinion that an auctioneer of their standing could reasonably reach and there was no breach of duty in that regard. Since C were not in breach of duty to T, her claim for misrepresentation also failed. |
