Summary, etc. Examines the new consultancy agreement produced by the British Property Federation (BPF) in association with Workplace Law Group after almost a decade of preparatory work. The BPF Consultancy Agreement enters a market where many different forms of consultancy agreements are already available to developers but these are normally drawn in favour of the consultant and do not take into account the requirements of funders. Looks at the background of the BPF Consultancy Agreement and the detailed terms of the agreement. Points out that the new agreement does not include a net contribution clause nor does it include a cap on the consultant's liability for breach. Concludes that the BPF agreement represents an excellent starting point for construction industry clients intending to use two-stage design-and-build procurement routes and a brave attempt at introducing standardisation into a market place dominated by custom-drafted documents.
