S appealed against an earlier decision to refuse its application for judicial review, on the grounds that s3(4) did not allow for an appeal to CA and that there were no exceptional circumstances, of the LT's refusal to permit an appeal from a Leasehold Valuation Tribunal (LVT) determination. "Held": the appeal was dismissed as the LTs refusal could not be appealed to CA under s3(4) and the circumstances were not exceptional.
