The amendments provide that a contractual mechanism for payment will only be valid if it requires a statement of what is due in a certificate issued by either the payer or payee, or a third party named in the contract. The DTI is not prepared, however, to take action to outlaw pay-if-paid clauses, or to make provision for stage payments for off-site work, both of which have strong support in the industry.
