Summary, etc. Describes and comments upon "Ove Arup and Partners Ltd v Mirant Asia-Pacific Construction (Hong Kong) Ltd" ([2005] EWCA Civ 1585, L133444) which considered the extent to which an engineering designer was obliged to verify its initial design assumptions. The court held that where a designer has insufficient information on which to complete part of a design, it is justified in proceeding on assumptions, but is obliged to obtain the information required to verify those assumptions, and inform the client when that information has been obtained.
