Summary, etc. [2006] UKHL 25, 24 May 2006. Concerns the period of use for sports and leisure pursuits required in order to satisfy the definition of town or village green for the purposes of the Commons Registration Act 1965 S22(1A). Appeal by R against a decision ([2005] EWCA Civ 175, Abs68865) which gave guidance on matters arising from R's application under the 1965 Act for registration of land owned by OCC as a town or village green. R had applied for registration of the land as a class c green within s22(1A) of the Act on the grounds that local residents had used the land lawfully as of right for leisure pursuits for an unbroken period of 20 years and continued to do so. OCC objected to R's application for registration despite the recommendation of a non-statutory inquiry. OCC sought the direction of the court for determination on a number of issues. "Held": the inhabitants of a locality must in order to satisfy the definition of town or village green in s22(1A) of the Act, continue to use the land for sports and related pastimes for a period of 20 years until the date.
