Historically, one has had to appeal to the common law of nuisance or go to local authority environmental health officers. Due to the limitations of the law of nusiance to deal with noise pollution it is likely that the provisions of the Convention for the Protection of the Human Rights and Fundamental Freedoms Art 8 and First Protocol Art 1 will need to be enlisted to help solve these issues. Discusses various case law where noise pollution has been the subject of an action under human rights law. |
