Summary, etc. CA 8 November 1995. In December 1980 the plaintiff (M) demised office premises to D with absolute prohibition on assignment or parting with possession. December 1988 M granted D consent to assign the underlease to N, the defendants (B) being directors of this company were parties to the licence as sureties. In September 1990 M consented assignment of underlease to C, including allowing occupation of part of premises to a company which was part of the same group of companies as C. In September 1992 C went into receivership owing M £59768.20 in rent arrears, service charges and insurance. B appealed against an earlier ruling giving summary judgment to M. Appeal dismissed.
