Summary, etc. [2007] EWCA Civ 404, 2 May 2007. Considers whether an assured tenancy ends on the date that possession is demanded, or continues until the date of vacation. W had been an assured tenant of her social landlord K. After accruing rent arrears she was served a possession order, but this was not put into effect since an agreement was reached. She was refused her right to buy the property as her tenancy had ended. W appealed against this decision, arguing that her continued residence represented the currency of the tenancy. "Held": The suspension of the possession order granted rights similar to those of the tenancy, but did not represent the continuation of that tenancy. The tenancy did not continue until the property was given up. The appeal was dismissed.
