| Summary, etc. | [2007] UKHL 21. Heard together with Douglas v Hello! Ltd and OBJ Ltd v Allan. M appealed against a decision that Y was not liable for the tort of interference with contractual relations. Two directors of M had diverted a property opportunity to a joint venture in which they were interested. This was in breach of their contract with M. Y wrongly believed that they would not be in breach and provided finance for the transaction. ?Held?: If the breach of contract was not the purpose of an action, but merely a foreseeable consequence, then it could not be said to be intentional. Accordingly, there had been no breach of contract and therefore no liability for interference. Y honestly believed that he would not be involved in a breach of contract. He could not be said to have been indifferent to such a breach. Appeal dismissed. |
