| Summary, etc. | [2007] EWLands RA_83_2006. 18 July 2007.The appellant valuation officer appealed against a valuation tribunal decision to cut the rateable value of retail premises owned by the respondent ratepayer (B) in a shopping centre. B proposed to alter the rating list because the entry was inaccurate; it had increased much more than other shops in the centre. The valuation officer defended the rateable value compared to a number of comparable settlements on shops in the centre and argued that a tone of list had been established. Not accepted by the tribunal. The Valuation officer appealed following a re-measurement of the premises, arguing the tribunal had failed to consider relevant comparable evidence establishing a tone of list. Held: appeal allowed. The tribunal had been wrong to reject the evidence of the valuation officer; a tone of list had been established and it was right to give weight to settlements agreed with occupiers and their agents. |
