Summary, etc. [2007] EWHC 2546 (TCC), 31 July 2007. Claimant authority (LFEPA) claimed damages against the defendant engineering practice (H) and the defendant contractors (L) in contract and tort in relation to an uncontrolled fire that broke out at LFEPA's training centre. LFEPA claimed for the cost of repair of the damage caused by the fire, the cost of investigation of the cause of the fire, replacement of defective ductwork and associated equipment, and loss of use of the training centre when it was closed for investigation, remedial works and commissioning. It was found that H was negligent but that H's negligence did not result in loss. It was also found that L was in breach of contract because of the defective ductwork but was not liable for the remedial costs because the client had not undertaken the remedial works.
