Summary, etc. [2007] EWCH 2510 (Ch).The directors of a claimant property developer firm, Fairbriar (F) sued their ex-managing director, van Reyk (V), for damages over breach of his duties over the terms of a business deal. V tried to have the claim dismissed on the grounds that, under the terms agreed on his leaving the firm, neither party can make a claim against the other. The most important issue was the extent of any release from liability. Held: claim in favour of the claimant (F). The claim can go ahead because the leaving agreement does not cover claims relating to potential failings by V as managing director.
