The case considers whether two secretaries of state took into account relevant information and gave valid reasons for their decisions in granting planning permission for expansion of Stansted airport. Carol Barbone and Brian Ross (on behalf of Stop Stansted Expansion) (B) opposed an expansion project of Stansted Airport. The Secretary of State for Transport and Secretary of State for Communities and Local Government allowed an appeal by BAA Ltd and Stansted Airport Ltd against the refusal of Uttlesford District Council (U) and others to allow planning permission to expand Stansted airport capacity. U had refused an expansion of the airport. On appeal, the secretaries granted permission for the expansion. B argued that the two secretaries should have considered all the environmental impacts of such expansion, as required by the Future of Transport White Paper (2003) ; acted in breach of legitimate expectation; and acted in breach of the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999 by not taking into account all the environmental information before granting planning permission. "Held": The two secretaries did not disregard the national transport planning policy for air transport development. They took into account material considerations related to C?s complaint. They also respected the 1999 Regulations. They gave valid reasons to support their conclusions. The application is refused.
