| Summary, etc. | [2009] EWCA Civ 1080, 20 October 2009. The case relates to the grant of accommodation to tenants by a local authority officer in without regard to the local authority's allocation scheme. A local officer granted tenancy of empty properties to several persons without respecting the local authority's application scheme procedure. This local authority, Birmingham City Council (B), claimed possession on ground of void tenancy. The possession claim was dismissed by the judge of the county court. B appealed the case. "Held": application dismissed. The allocation of an assured tenancy and the grant of such a tenancy are two different concepts. So if a local authority granted a tenancy to a tenant to whom accommodation had been allocated without respecting the local authority's allocation scheme, the tenancy is not thereby rendered void or ineffective. |
