Appellant (S) claimed its entitlement to receive an overage payment from respondent (H) pursuant to the terms of an agreement regarding the sale of a porter's flat. Sale of flat prevented by enfranchisement of block under Leasehold Reform Housing and Urban Development Act 1993 as it became part of the common parts which tenants were entitled to acquire. Held: appeal dismissed. Contract had been discharged by fustration without fault from either parties.
