Summary, etc. [2010] EWHC 2374 (Ch), 24 September 2010. A loan to defendant S was secured by a charge over S's property registered at the Land Registry in 2000. Defendant B lent S money to redeem the earlier charge and received an executed charge in 2006. B did not protect its loan at the Land Registry until 2009 whereas an equitable charge in favour of claimant A had been registered on S's title in the meantime. Who had priority? Held: Although B did not protect its loan to S at the Land Registry until 2009, it was entitled to gain priority through subrogation over lenders registered earlier.
