Appeal against claim for breach of duty of care in relation to a valuation report for a property being purchased for buy-to-let purposes as an investment income. Duty of care claim dismissed on grounds that a property being purchased on a buy-to- let basis is a commercial transaction rather than a purchase being purchased for owner occupation as a modest residential property. Independent valuation advice on rental income to have been achieved should have been sought. "Held" Appeal allowed.
