Reports on the findings of a project to reform the means by which a landlord can terminate a fixed term commercial or residential tenancy where the tenant has not complied with their obligations. Makes the following provisional proposals: to abolish the current law of forfeiture of tenancies and the related doctrine of waver; to create a new statutory scheme for termination of fixed term commercial tenancies and residential tenancies of 21 years or more; to require landlords to give pre-action notice to tenants and any qualifying derivative stakeholders of their intention to terminate a tenancy for tenant default; to give courts a structured discretion to make a a range of orders as well as termination, and to provide a modified regime whereby landlords may recover possession unilaterally.
