QBD 1 December 1995. N made a compulsory purchase order for the purpose of constructing a sewage treatment works. N served a notice to treat and took possession of the land in January 1993. No work was undertaken in relation to the sewage works. A certificate of appropriate alternative development under the Land Compensation Act 1961 s17 was granted and A submitted a claim for compensation for £22m. N withdrew the notice to treat and asked for an advance payment to be returned. A sought judicial review of N`s decision to withdraw the notice to treat. "Held" N was entitled to withdraw notice to treat. Application dismissed.
