The planning authority served enforcement notices on the appellants and they appealed to the SOS under Town and Country Planning Act 1971 s88 . By s88(10) an enforcement notice was, pending final determination or withdrawal of an appeal under s88, of no effect. SOS dismissed the appeals and the appellants appealed to the High Court under s246 of the 1971 Act. SOS reheard the appeals under s88 and upheld the enforcement notices.
