A paper presented at the COBRA Conference in New Delhi on 10-12 September 2013. Looks at payment claim splitting in adjudication specifically relating to Australia. Considers the bars to claim splitting in litigation, the absence of bars to claim splitting in expert determination and contends that claim splitting in adjudication stands part way between the two. The paper points out the risks of claim splitting and suggests what an adjudicator should do when a claimant asks the adjudicator to determine only some of the items in a payment claim.
