It was agreed that the agricultural value of the land was £5,500 however the claimant said that the land had a special value because it was providing access and increased the value to £1.240,000, being 75% of the gain in the value of the development area when the access land was acquired. It was not disputed that the value of the land must exclude any increase or decrease in value attributable to the scheme. The council claimed that as the land was acquired to replace an existing highway it was debarred by the Land Compensation Act 1961 from paying any more than £5,500. The claimants valuation of £1,240,000 was accepted.
