Examines the case "R v Swaffham Magistrates Court and another ex p Paul Rackham Ltd" ([2004] EWHC 1417 (Admin), unreported) which discussed the issue of what is the definition of waste. The claimant argued that the definition of waste was now so complicated that it was impossible for a person to determine what was waste and that their material and product were recovered products and no longer controlled waste. Paul Rackham Ltd's application for permission to apply for a judicial review was refused and the case was returned to the magistrates courts. View judgment at www.bailii.org
