The decision was challenged on the basis that SoS failed to take account of the substantial amounts of extra traffic which the scheme would place on the M63 motorway and of various changes which had taken place since the first inquiry of 1988 in both fact and policy particularly in respect of retail impact issues. B also contended that SoS had failed in his duty to give adequate reasons for his decision. Application dismissed. The decision letter read as a whole left no doubt that SoS had looked at all matters before him at the time the decision was issued.
