The plaintiff landlord (K) had granted a headlease, of premises comprising a house divided into five flats, for 60 years. The head lessees sublet the flats for 55 years to the defendant tenants. As a result of non-payment of rent an order for possession was granted to K against the head lessees. The appeal by K was against the decision that the defendants became protected tenants in the new relationship. Appeal dismissed.
