Title was unregistered, and the lease remained in C`s name, whilst AR was responsible for all outgoings on the property. In 1986 C charged the property to L without telling them that AR was living there. When, in 1991, L sought repayment of monies owed and subsequent possession, C claimed he held the property as bare trustee for AR. L claimed that AR`s interest was as an unregistered estate contract and was void against L. L`s appeal against an earlier decision that there was no registrable interest, was upheld.
