In "Audsley and another v Leeds City Council and another" , QBD 6 May 1988, the house-owners` claim for damages for loss and inconvenience was dismissed. They alleged negligence and/or breach of statutory duty by the council and a builder who had been engaged by the previous house-owner to erect an extension. Though the extension had building defects , failure by the previous house-owner to assign the right to sue for negligence was fatal to an otherwise good claim.
