In Pittalis it was held that a flat above a shop was not to be treated as a dwelling-house and in the Maunsell case a subtenant of a cottage forming part of an agricultural holding was not protected against the head landlord by the predecessor of s137 (3). Concludes with the view that the difficulties caused by s173 (3) should be eased by Housing Act 1988 .
