Morris v Patel and Others
Language: English Series: Estates Gazette ; 281 (6319) 31 January 1987, 419 (1)Publication details: 1987Subject(s): Summary: CA 15 July 1986. Application by the tenant for leave to appeal and an extension of time for appealing from an order in the county court. The order dismissed an application by the plaintiff for a declaration that the notice served on him by the landlords purporting to terminate his business tenancy, was invalid. The landlords` notice was in an old form which had been replaced by a new form which differed in several ways. The judge decided that the old form, however, was substantially to the same effect as the new one, and refused leave to appeal. The present application was out of time because the plaintiff and his solicitors had not appreciated the urgency of the application. Held that there was not enough in the appeal to merit the granting of leave to appeal. Application dismissed.| Item type | Current library | Call number | Copy number | Status | Barcode | |
