An appeal against the decision that the appellant was not entitled to succeed his mother as a secure tenant because his mother, initially a joint tenant , on becoming a sole tenant had become a successor and further succession was not allowed under Housing Act 1985 s87 and 88. It was held that these sections concerned a single tenancy and that the mother was not a joint and sole tenant under the same tenancy. Appeal allowed.
