A notice to pay rent under Case D(a) dated November 18 1986 required payment within two months from service of the notice. Payment of rent was not made until 6 February 1987. Accordingly a notice to quit was sent on 23 March 1987, terminating the tenancy on 6 April 1988. H claimed the notice had been temporarily misplaced which had caused the delay. Throughout the period M and their agents were in discussion with H who had financial difficulties. A critical meeting took place on 7 August 1987 at the request of H.
