"Thomas and another v Countryside Council for Wales" QBD 23 July 1993. An arbitrator was wrong to assess compensation under Wildlife and Countryside Act 1981 for the creation of an area of special scientific interest only on the financial loss to the farmer. Amenity and and aesthetic preference should be considered.
