The second plaintiff (X) subunderlet part of an office block to the defendant tenants (P) for a 5 year term from 15 February 1988. On the same date the first plaintiff (E) sublet the whole office block to P (subject to the subunderlease) also for 5 years. P occupied the whole block until December 1992 and had removed all their equipment by 5 February 1993. E and X sought rent from P until June 1993 on the basis that no notices satisfying the Landlord and Tent Act 1954 s27(2) were served until 5 and 15 January 1993, expressing to expire in June 1993. E and X contended that because occupation was given up before the term date, no notice was due. Held that tenancy within the protection of the landlord and Tenant Act 1954.
