H, the respondent, made termination of the tenancy a condition of rehousing Mrs Powell. Accordingly, she gave a notice to quit without M`s knowledge, against whom proceedings to regain possession were brought. The CC decision that the notice was invalid was overturned by the CA, who granted an order of possession. M appealed, basing his argument on contractual principle, but his case was dismissed.
