N were granted outline planning permission for a hotel in 1982 and reserved matters were approved in 1985 subject to the condition that work had to begin within two years i.e. by 19 July 1987, of the permission would lapse. On 25 May 1988 the council issued an enforcement notice alleging that work done in 1988 was out of time. They issued a stop notice. On appeal an Inspector quashed the enforcement notice on the grounds that N had done some work pre July 1987 and that was sufficient to keep the permission alive. The stop notice ceased to have effect on 2 February 1989. The council claimed that the period for claiming compensation under s177 of the 1971 Act ceased on 2 August 1989. The council`s appeal was dismissed in January 1990. On 9 August 1989 N requested by letter that SOS exercise his discretion to extend the period of time for claiming compensation under Town and Country Planning General Regulations 1976.
