Summary: In Fletcher v Chelmsford BC LT 22 July 1991, the claimant`s application for the cost of obtaining an expert`s report for the investigation and monitoring of the effect of a tree on a building was upheld. as a result of a tree preservation order the claimant was entitled for compensation for his uninsured losses under Town and Country Planning Act 1971 s174 .
