C claimed the second house was valued at £56,000 making a total purchase price of £109,000 on which 3% commission had been agreed. C brought proceedings for this commission at the county court. It was held that the purchase price had only been £53,000. C appealed contending that the purchase price included boththe cash and the part exchange element.
