R commenced proceedings to recover overpayment of rent which W stated that under the Rent Act 1977 s57(3)(b) R was entitled to recover overpayment for a 2-year period only. W served notice under Landlord and Tenant Act 1987 s48 on R. Judge dismissed R's claim and allowed W`s counterclaim for arrears of rent. R appealed.
