Reviews the issues involved when considering a contractor`s proof of excusable delay in completion of the construction works, when `as-built` records are not available. Uses the recent case "John Barker Construction Ltd v London Portman Hotel Ltd" ([1996] 12 Const.L.J. 277) as an example. Includes criteria for maintaining `as-built` records.
