Canterbury CC then let a dwelling house to B under a secure tenancy to which the Housing Act 1985 s92 applied, entitling B to assign the tenancy to another secure tenantor an assured tenant of a housing association. B and S completed forms to exchange their tenancies and S assigned benefit of her tenancy to B. Housing association sought an order for possesison against B on grounds there had been a fraud by B and S. B and ger partner appealed. Appeal allowed.
