"Northumberland and Durham Property Trust Ltd v London Rent Assessment Committee", QBD 1 April 1998. N owned three flats, subject of two appeals against fair rent assessments. In the first appeal, L considered evidence of high scarcity against submissions by N for an 8.4% allowance. L concluded scarcity was severe. In second appeal L deducted 50% for scarcity. N complained area of comparison too restricted and that L had applied the wrong test in considering scarcity. Both appeals allowed.
